Loyalty Card Terms and Conditions
General Provisions
- The Organizer of the Loyalty Card loyalty program is Delizie Italiane LTD, conducted within the framework of its own business activity.
- The program is aimed at customers of the Organizer’s establishments and is intended to reward their loyalty and daily purchases by enabling the accumulation and use of points with the Customer Loyalty Card.
- The Organizer’s establishments include the restaurant Da Luciano in Warsaw at Herbu Oksza 24.
- These Loyalty Program Terms and Conditions, referred to hereinafter as the ‘Regulations,’ define the rules for issuing and using Loyalty Cards.
- Each card will accumulate points as a reward for purchases of a specified value.
- Customer identification and the ability to accumulate points on the card occur when the card is scanned at the cash register during a transaction at the Organizer’s establishments.
- The Loyalty Card can be opened and used by a natural person with full legal capacity.
Issuance of the Loyalty Card
- To receive a Loyalty Card, the Customer must submit a signed personal data protection declaration to an employee of the Establishment.
- The completed declaration is given to the Establishment employee, and in return, the Customer receives a free Loyalty Card.
Accumulating and Issuing Points
- The Loyalty Card allows the accumulation of points awarded for a single purchase of goods or services worth at least 10 PLN.
- The Loyalty Cardholder receives 1 point for every full 10 PLN spent.
- The Customer should present the Loyalty Card to the Establishment employee at the beginning of the transaction for scanning each time they go through the cash register. This identification will allow points to be accumulated on the card each time.
- When using the accumulated points on the Loyalty Card, a discount is applied proportionally to all products/services in the transaction.
- If the Customer wants to use the points accumulated on the Loyalty Card, and the value of the purchased products/services exceeds the value of the discounts accumulated on the Loyalty Card, the Customer pays the remaining amount in cash. If the value of the purchased products/services is less than the value of the discounts accumulated on the Loyalty Card (considering section 4 above), the amount equal to the value of the discounts is deducted from the Loyalty Card, and the unused points remain on the Loyalty Card.
Procedure in Case of Loss of the Loyalty Card
- In the scope of using the Program described in the Regulations, the Loyalty Card is considered a bearer card. The Organizer is not responsible for any damages suffered by the Customer due to transactions made by unauthorized persons if they came into possession of the Loyalty Card due to reasons attributable to the Customer.
- The Customer is obliged to immediately inform the Organizer’s employees in person or by email (biuro@bottegadelgusto.pl) about the loss of the Loyalty Card and request its blocking. Blocking the Loyalty Card is done by the Organizer’s employee immediately after receiving the Customer’s information about the loss and the instruction to block the Loyalty Card.
- The Customer has the right to receive a new Loyalty Card in case of loss, destruction, or damage preventing its use. This occurs after submitting a written request and presenting a document confirming the identity of the person submitting the request. The Customer is entitled to receive a new Loyalty Card with a new number along with the current points balance.
Complaints
- Complaints related to the Program should be submitted in writing at any of the Organizer’s establishments or electronically to the email address.
- Within 14 days from the date of receipt of the complaint, the Organizer will consider the complaint and respond in writing or by email (depending on the preferred contact method of the person submitting the complaint).
- Complaints are considered in accordance with the provisions of the Regulations and the generally applicable law in Poland.
Termination of Participation in the Program
- The Customer may withdraw from the Program at any time by submitting a relevant statement to the Organizer. The withdrawal takes effect immediately. The statement of withdrawal from the Program can be submitted at any of the Organizer’s establishments, including those operating under the ‘Bottega del Gusto’ brand.
- The Organizer may temporarily block the Loyalty Card for important reasons such as:
- justified suspicion of gross violation of the Regulations by the Customer;
- obtaining reliable information or an official notification that the Loyalty Card has been taken over by an unauthorized person;
- and when it is necessary, for security reasons to protect the essential interests of the Customer or the Organizer.
- During the blocking period, the Loyalty Card is not available, and no operations can be performed on it. The blocking of the Loyalty Card lasts for the time necessary to clarify the matter or the reasons for which it was imposed — as much as possible, not longer than 30 days.
- The Organizer notifies the Customer about the blocking of the Account, its reasons, and the unblocking of the Loyalty Card using available contact channels (e.g., email, SMS).
- For important reasons, the Organizer may terminate the Customer’s participation in the Program at any time. Important reasons, as mentioned in the preceding sentence, include:
- engaging in unlawful conduct by the Customer regarding participation in the Program;
- gross violation of the Regulations by the Customer (especially leading to undue benefits at the expense of the Organizer);
- and repeated other violations of the Regulations by the Customer despite receiving prior warnings from the Organizer.
- Termination may be made electronically or in writing, indicating the reason for termination and with a 14-day notice period. The Customer whose participation in the Program has been terminated may appeal the termination within 14 days from the date of receiving the termination statement by sending an appeal to the Organizer’s headquarters address or by email to biuro@bottegadelgusto.pl. The appeal will be considered within 14 days of its receipt.
- A Loyalty Card on which no transaction has been performed for 3 years will be removed.
- Termination of participation in the Program results in the loss of accumulated and unused Points on the Loyalty Account.
Personal Data Protection

Additional Provisions
- Points accumulated on the Loyalty Card are not exchangeable for cash.
- The Customer cannot manage the accumulated Points in a manner different from what is provided for in the Regulations. In particular, the Customer cannot establish security on the Loyalty Card, withdraw the accumulated Points, or issue instructions not provided for in the Regulations.
- The Organizer does not charge the Customer any fees or remuneration for using the Loyalty Card. The issuance of the Card is free.
- In the case of using the Card and the Loyalty Program contrary to its objectives and provisions, the Organizer reserves the right to block the Loyalty Card.
